Central Council of the Non-Confessional in Austria Sues the European Commission

The ORF Act violates EU state aid law by competitively distorting the market in favour of legally recognised churches through free media presence and control mandates, while non-confessional people are discriminated against.

Those churches which deny the moral integrity of the non-religious on account of their 'godlessness' are given a free PR stage through the ORF Act.

The Central Council of the Non-Confessional in Austria has sued the European Commission for inaction. The association argues that the ORF Act discriminatorily favours legally recognised churches through free advertising platforms and guaranteed seats on the public council. Non-confessional people, who make up around 34 percent of the population, have to pay the levy but have no access to their own formats or control bodies. The European Commission had dismissed the original state aid complaint, as no immediate economic detriment was found. The Central Council then filed an action for annulment to compel a review of the competitively distorting subsidy. A partial success is cited in the planned removal of the VAT compensation for ORF from 2027, which is a political response to the EU complaint. The goal is to end the one-sided subsidisation of churches and to have the funds repaid.

Law Central Council of Non-Confessional People in Austria sues the European Commission Due to its inaction regarding the funding of the ORF, the Central Council of Non-Confessional People in Austria has sued the European Commission. Central Council of Non-Confessional People in Austria 10.09.2026 The European Commission in Brussels Photo: Dominik Leitner via Flickr CC BY-NC-ND 2.0 Over three million people – that is approximately 34 percent of the population in Austria – are without religious affiliation. In Vienna, this proportion is even around 48 percent. Non-confessional people also have to co-finance the public broadcasting (ORF) through a household levy. The problem with this: The ORF provides legally recognized churches with a free advertising platform for their dogmas and commercial services, while it ignores the worldview of non-confessional people. Those churches which deny moral integrity to non-religious people on account of their “godlessness” receive a free PR stage through the ORF Act. What is the reason for the legal steps of the Austrian Central Council in Brussels? The ORF Act prescribes to the ORF in its public service broadcasting mandate that it shall enable the churches to have free advertising (quote: “the appropriate consideration of the significance of the legally recognized churches and religious communities”) with the funds of all contributors. Whether church weddings, baptisms, or pastoral care – the churches charge hefty prices for these ceremonies (so-called “stole fees” – the term derives from the liturgical stole) and also receive free coverage in the ORF. Secular service providers who offer humanist weddings or welcome ceremonies for babies, name-giving ceremonies, or eulogies, as well as secular portals (such as the website konfessionsfrei.at of the Central Council) and who must fight for every reader and every euro, simply do not appear in the ORF Act. The legal discrimination of non-confessional people continues in the ORF’s control and interest representation body: While the ORF Act grants the Catholic and the Protestant Church (the latter representing only 2.6% of the population) each a legally guaranteed direct mandate in the important ORF Public Council, it denies non-confessional people any seat in this important body. The disadvantage of non-confessional people in the ORF Act concretely affects the ORF program: Unlike for churches, there is not a single own format for non-confessional people in the entire ORF program. Socially relevant topics such as the process of secularization, secular life rituals, information about leaving the church, or the critical debate about church privileges in general are systematically concealed or at least marginalized. The Central Council of Non-Confessional People in Austria submitted an official EU state aid complaint to the European Commission in May of this year (the hpd reported on this) to combat this unfair preference. This comprehensive complaint was drafted for the Central Council by the Vice President of the Central Council and EU state aid law expert Clemens Lintschinger. What was the response from the EU Commission? The response from Brussels was a textbook example of bureaucratic evasions: The European Commission did not want to acknowledge the submission of the Central Council as a formal complaint. Its reasoning: Precisely because the ORF does not offer non-confessional formats, the Central Council is not a “party concerned” within the meaning of EU state aid law, as there is no immediate economic impairment. The disadvantages for people without a confession are merely of a general or worldview nature. The complaint was registered by the Commission merely as “general market information”. Current Step: The Action for Annulment Because the European Commission refused to officially examine this competition-distorting church privilege, the Central Council of the Non-Confessional filed an action for annulment against the European Commission before the Court of Justice of the European Union. The action was drafted by the Vice-President but editorially processed in a time-consuming manner by lawyer Andreas Manak in accordance with EU formal requirements. The legal measures have already achieved a notable political partial success To compensate ORF for the loss of input tax deduction, the federal government has so far transferred approximately 90 million euros annually to ORF as input tax compensation. According to the expert opinion by Clemens Lintschinger, this constitutes a new aid measure that had not been notified to the Commission. The production of church formats and the broadcasting of religious contributions are also made possible with these funds. As revealed in a session of the Federal Council in the summer, the Republic of Austria plans to cut this subsidy from 2027 onwards – explicitly because there is a complaint at the EU level against this unnotified aid. However, it must be noted that no EU complaint is recorded in the Commission’s State Aid Register! To date, only the complaint by the Central Council is publicly known. By intending to amend the ORF Act with reference to the EU complaint, the political authorities have in fact acknowledged that the argumentation in the EU State Aid complaint is valid. The Central Council has thereby ended this method of unilateral, competition-distorting promotion of legally recognized churches by ORF. How this matter will proceed The Central Council intends to continue its legal battle to ensure that ORF must refund the money to the fee payers. In addition, the Central Council continues to pursue, through its action, the primary objective of having the Court compel the Commission to examine whether the ORF legislator promotes the economic activities of churches through church privileges in ORF. The association understands itself as an offer for the representation of interests of ideologically open non-confessional people. It fights against the legal discrimination of atheistic and agnostic people, but also of those who do not belong to any religious worldview community, and also of believing people who are not members of a legally recognized church, religious community, or religious confession community.
