German suicide prevention must be designed in accordance with constitutional law so that it reconciles the protection of people in acute crisis with the acceptance and support of well-considered, autonomous decisions to commit suicide.

Responsible assistance for a well-considered suicide must go hand in hand with protecting people in acute crisis from self-endangerment, who would not be capable of insight or decision-making.

The text analyzes the German campaign for World Suicide Prevention Day and places it in the context of the Federal Constitutional Court ruling of 2020. It argues that the current national strategy, which is based exclusively on affirmation of life and prevention, conflicts with the constitutionally protected right to self-determined dying. The author calls for an integrative policy that distinguishes between people in acute crisis and those with a well-considered intention to commit suicide. It is criticized that organizations such as NaSPro and churches are erecting new barriers to assisted dying, while at the same time there are gaps in palliative care provision. The text advocates for a legal framework that guarantees both protection against impulsive actions and the acceptance of autonomous decisions. It refers to statements by various stakeholders who call for this differentiation in order to implement the constitutional situation in practice.

Health Life, valuable to all, as the core message World Suicide Prevention Day to prevent self-killing On today’s World Suicide Prevention Day, the most comprehensive prevention of suicides is once again promoted. The national campaign traditionally pursues exclusively the goal of setting a “sign for life.” In Germany, constitutionally compliant integrative approaches should long since exist: Responsible assistance for a well-considered suicide must go hand in hand with protection against self-endangerment of people in acute crisis who are not capable of insight and decision-making. Gita Neumann 10.09.2026 Photo: Andrea Piacquadio via Pexels Pexels License With its international day of action, the World Health Organization (WHO) has attempted since 2003 to break the stigmatization of mental crises and, in particular, the wall of silence regarding suicidality. Who would not welcome it if barriers were dismantled worldwide to promote a more open approach and social support services for those affected (on other continents, they are often younger) in their interest? Likewise, no one would object if, here at home, the palliative medical, psycho-social, and geriatric nursing care for predominantly elderly, care-dependent, or sick people were significantly improved. This equally concerns accessible therapeutic offers in the psychiatric-psychotherapeutic field to prevent desperate, spontaneous, and unconsidered self-killing. However, the national campaign for the World Prevention Day sets other accents for the education and sensitization of the population. Its slogans such as “You are not alone, help is close and reachable” might not appear particularly inviting, at least to people seeking advice who, for example, are considering leaving life self-determinedly in the event of care dependency in old age, even with low-threshold offers. German Campaign for World Suicide Prevention Day The specialist network “NaSPro” (National Suicide Prevention Program) is supported by more than 90 institutions and organizations and backed in its public-facing messages. The nationwide campaign for this year’s World Day was developed primarily by “NaSPro” and is carried out jointly, partly in local networks. For this purpose, provided materials are used, for example, for short, medium-length, or detailed image and film stories, as well as numerous references to regional and nationwide support offers. In the background, another goal is pursued: The World Day on September 10 is used as an occasion to demand sufficient state funds. The suicide prevention program “NaSPro” now demands a permanent financing of 50 to 60 million euros annually in the federal budget and, in addition, reliable financing for its (own structural coordination of 500,000 euros). With this, its original idea of a foundation fund of at least 20 million from 2023 has been corrected upwards to three times that amount. A legal anchoring in the planned Suicide Prevention Act is considered indispensable for this. This corresponds to a Bundestag resolution already passed in 2023 by an overwhelming majority. Due to this, a newly submitted draft from the Federal Ministry of Health was made public for discussion in the summer of 2026. New Barriers in the Garb of Welcomingness Restrictions and barriers to suicide prevention contained in the submitted Prevention Act also encounter joint opposition from, for example, churches, the medical profession, and organizations. The representatives of "NaSPro," and above all of psychiatry associations, are concerned, as always with their actions and statements, with drastically reducing the number of over 10,000 statistically registered suicides (with an additionally high dark figure). This would equally affect the approximately 10 percent of the suicide statistics that include assisted dying by associations or physician-assisted suicides in treatment situations. If the free responsibility of those committing suicide is present, assistance in their death is, according to the Federal Constitutional Court ruling of 2020, not only legal and permissible. Furthermore, according to the Karlsruhe judges, the ending of one's own life as an expression of constitutionally guaranteed autonomy must also be socially accepted. This legal and constitutional situation in Germany is characterized on an international scale by a nearly unique liberalism. Consequently, some of the nationally demanded measures for suicide prevention would erect new barriers, instead of merely dismantling the discriminatory hurdles according to the WHO target. The stated goal of the national campaign for September 10 is, according to its own statement, "to change the societal narrative around suicide." For this purpose, the motto "Your story is not over" was developed together with a media working group and students of communication psychology. It is intended to convey to the public the conviction that suicides can, should, and must be prevented through listening, taking seriously, life-affirming hope, and corresponding caring action. The campaign makes a comprehensive claim, addressing all those affected by suicidal thoughts, stating: "Every phase of life brings its own challenges. Doubts, feeling overwhelmed, or the feeling of being stuck can affect people at very different moments in their lives." The campaign motto is intended to clarify: "Even difficult chapters are not the end of a story. There are turning points. You are not alone. Help is close and accessible." However, not all target groups will feel taken seriously and addressed by these words. Law against care gaps and for restrictions "NaSPro" works closely with the Federal Ministry of Health at the political level, among other things. It is pushing for the adoption of the bill on suicide prevention formulated there, dated June 25, 2026. In view of significant care gaps in the area of crisis services, psycho-social and therapeutic offerings, this is a health-policy significant goal. According to the bill, the costs to the federal government would amount to just under 1.5 million euros annually (the "NaSPro" now demands 50–60 million) plus one-time additional costs of a similar magnitude. Costs for model projects are to be borne by the statutory health insurance funds, but only minor costs by the federal states. These would be obliged to work towards regional contact points as well as information and assistance offers, which would then be digitally bundled by a new federal specialist office. The bill contains, in addition, numerous far-reaching measures for the preventive prevention of suicides. The demand from psychiatry for so-called “method restriction” is taken into account in that it is planned nationwide to make access to lethal suicide means and methods more difficult. Furthermore, legal requirements are in focus regarding what must be considered in terms of construction (e.g., through fences, barriers, and nets) for bridges, railway tracks, or correctional facilities. In addition, the role of hospice and palliative care in suicide prevention is to be strengthened. The problem is that, in accordance with the Church and partly with politics, representatives of “NaSPro” and psychiatry consider assisted suicide to be incompatible with their life protection principles. This meets with objection and serious concerns, about which the hpd reported. There, the assessment by the Institute for Worldview Law of an absolutized suicide prevention is summarized as follows: The creation of a comprehensive support system for those affected is, in view of the state’s duty to protect, fundamentally legitimate and sensible. However, the law does not sufficiently differentiate between persons in an acute suicide crisis and those who have made a well-informed and well-considered decision to commit suicide. This could carry the risk that, through state suicide prevention measures, an attempt would be made to deter also freely responsible affected persons from their resolve to carry out a suicide plan, instead of accepting it. Voices on the suicide prevention approach in Germany The basic outlines in the draft from summer 2026 for a suicide prevention law are welcomed by all sides, for example by the Diakonie, telephone counseling, and associations of doctors, welfare organizations, and psychiatry, as steps towards a better care situation in crisis situations. Most demands for improvement refer to a binding financing for the planned expansion as well as for the existing ambulatory crisis services and their networking. In the statement by Caritas and the Catholic Office, another concern in their own matter is raised: “From our point of view, an advertising ban for assisted suicide, but also regulations for the access of euthanasia organizations to certain locations” (such as nursing homes, psychiatric facilities, or hospitals) “are effective measures of method restriction”. On the other side of the spectrum, the German Society for Humane Dying criticizes in its statement: The bill does not at least formally distinguish between “people with suicidal thoughts” and “those willing to die”. “This conceptual distinction is not merely a terminological question. It shapes the entire direction of the law (…). Where the law itself no longer makes a differentiation, there is a considerable risk that the subordinate actors will also treat every wish to die as an expression of a crisis to be overcome.” Regarding the challenging implementation of a constitutionally compliant practice, the Humanist Association of Germany (HVD) proposed model projects many years ago for "regional, also outreach-oriented counseling centers that cooperate at the municipal level with doctors and various institutions." To this end, the HVD federal association submitted a draft regulation as early as 2020 – shortly after the Federal Constitutional Court ruling – for joint counseling centers of different actors in the context of self-determined end-of-life, accompanied dying, and assisted suicide. Another contribution by the HVD from 2023 is titled with the demand to "jointly ensure autonomy in suicide assistance and suicide prevention." By now, it has become widely understood among the population that there is a right of personality to avail oneself of legally offered suicide assistance. The increasing number of people seeking advice and help who express wishes for a "humane death" provides all the more reason to meaningfully network different concepts and counseling approaches. Balancing seemingly insurmountable opposites In its statement on the draft law from summer, the Federal Working Group of Senior Organizations (BAGSO) also points out that previous counseling and educational offers have hardly reached the elderly population, even though this group is considered the most affected target group due to factors such as loneliness, illness, poverty, or the loss of close relatives. Furthermore, the BAGSO criticizes that, in the current project for national suicide prevention, people whose wish to die exhibits a particular "dynamics and stability – i.e., long-term nature" receive "no appropriate consideration." It demands a regulation in line with the ruling of the Federal Constitutional Court from 2020. Its provisions aim for a balance between two fundamental principles: The right of personality to self-determined dying must be granted space for development, but this must remain closely linked with the means of suicide prevention and deterrence. Whether the legislator can ever succeed in overcoming an "either-or" confrontation remains questionable. The Federal Constitutional Court emphasizes in its first guiding principle the autonomous self-determination "of the individual to end his or her life according to his or her understanding of quality of life and the meaningfulness of his or her own existence." The right of personality to be respected then applies equally to young and healthy people as well as to those suffering from severe age-related ailments or an illness leading to imminent death. However, for a wish to die to be constitutionally protected to such an extent that assistance thereto remains non-punishable, it must, under all circumstances, be based on the free responsibility of the person intending suicide. Regarding the decisive legal construct of free responsibility, the Karlsruhe judges have established a series of criteria. Only if those wishing to die fulfill these and are capable of forming a will does the assistance in self-killing remain permitted. Otherwise, even in the case of omission to avert or hinder self-endangerment, a potentially lengthy prison sentence is threatened. In the absence of free responsibility and decision-making capacity, the duty of protection towards the acute intention of self-killing of an affected person therefore applies, and thus a decisive factor of suicide prevention. That does not mean, however, that people capable of making voluntary decisions in crisis situations should not also receive support and, where there is a need for information, information within the framework of humanistic and open-ended counseling services. If such a request is made, appropriate information should be provided on the corresponding options and alternatives—embedded in care, attentive listening, and conversations that provide relief. This should also be aimed for in advance of decision-making regarding assisted dying—based on an underlying understanding and corresponding impulse when we encounter people in psychological, physical, or social distress.
