The SPD is instrumentalising the Islamist attack on the Berlin CSD to push through an unclear amendment to the Basic Law, rather than naming Islamist extremism as a real danger and carrying out targeted prevention work.

So soon after the Islamist attack on the Berlin CSD, political forces apparently want to instrumentalise the broad public outpouring of sympathy to push through an amendment to the Basic Law that, on closer inspection, reveals pitfalls and is moreover not strictly necessary to protect queer people in Germany.

The text analyses the SPD's political reaction to the Islamist attack on the Berlin CSD. It argues that the party is instrumentalising the attack to demand the expansion of Article 3 of the Basic Law to include 'sexual identity'. The author considers this measure insufficient and unclear, as the term 'sexual identity' is too indeterminate. Instead, he points to the already existing protective function of Articles 1, 2 and 3 of the Basic Law. He sees the real danger in the widespread homophobia in Muslim communities and in Islamist extremism. He therefore calls for prevention work and harsher penalties for radicalised individuals, rather than symbolic amendments to the Basic Law. The text criticises the political left for downplaying Islamism as a real danger.

After an Islamist carried out an attack on the CSD Berlin, above all left-wing parties continue as before on the topic of "Islamism": by looking away and ignoring it. The SPD is no exception. Instead of now clearly naming Islamist extremism as a danger, the party is now calling in the federal parliament for the expansion of Article 3 of the Basic Law to include "sexual identity." As early as 2019 at the CSD in Cologne, the expansion of Article 3 of the Basic Law was part of the list of demands (© Raimond Spekking / CC BY-SA 4.0 via Wikimedia Commons). By Till Randolf Amelung Already directly after the attack, the first demands came that the expansion of Article 3 of the Basic Law to include "sexual identity" should now be pursued. And Luigi Pantisano, the new party chairman of the Left Party and brother of spokesperson Alfonso, announced on Monday: "We as the Left are ready in the Bundestag for a two-thirds majority to implement this point immediately and to include it in Article 3 of the Basic Law." What this measure is supposed to achieve against religiously motivated hatred of Queers remains unclear. Nationwide, around 410 persons are classified as Islamist threats according to the Federal Criminal Police Office – a fundamentally manageable number. The far greater problem is the widespread homophobia in Muslim communities, which the jurist and Muslim Murat Kayman describes in his blog as a "general fact": "That in Muslim communities homosexuality is either not spoken about at all or spoken about in categories of illness and sin is not a suspicion. That queer Muslims in our communities are only tolerated on the condition that they remain invisible is not a suspicion. That in twenty-five years in Muslim structures I have never once experienced a community speaking on its own initiative, without external occasion, about its attitude toward and treatment of queer people is not a suspicion." Similar things can be said about the major Islamic organizations. SPD wants sexual identity in Article 3 of the Basic Law Now the SPD is also jumping on the Article 3 bandwagon. Its leadership trio, consisting of party chairpersons Bärbel Bas and Lars Klingbeil as well as General Secretary Tim Klüssendorf, announced on Tuesday to put the expansion of Article 3 of the Basic Law "with emphasis back on the political agenda." Such an expansion has been demanded for a long time by queer organizations. In September of last year, there was an initiative from the Bundesrat, led among others by the state of Berlin as a condition for Kai Wegener being allowed to be visible at the Berlin CSD. But this initiative is now with the Bundestag for deliberation and to this day nothing further has been done in the matter. So shortly after the Islamist attack on the CSD Berlin, political forces apparently want to instrumentalize the great public sympathy to push through a change to the Basic Law that, on closer inspection, reveals pitfalls and is also not necessarily required to protect queer people in Germany. Protection of queer people is already sufficient For one thing, the question is, what on earth a "sexual identity" is supposed to be and who can then invoke it with which sexuality? The term is too indeterminate, which is one of the essential reasons why CDU/CSU have so far rejected this Basic Law amendment. Who else should not be accidentally invited: Pedo-activists for the decriminalization of sex with children also see their drive destiny as an identity. Apart from that, queer people are already sufficiently protected by the Basic Law, as the legal experts of the Union also note. The Munich philosophy lecturer Andreas Edmüller explains in his blog that this protection does not arise solely from Article 3, but that Articles 1, 2, and 3 must be understood in mutual complementation: "The concept of dignity provides the basis and the inescapable framework for the understanding and interpretation of fundamental rights and the constitution. In particular, the personality, privacy, and intimate sphere of every citizen are consistently protected. The same applies to honor. Article 2 additionally guarantees the free development of personality, provided that the rights of other citizens, the constitution, or "the moral law" are not violated.6) The matter of the moral law has, over time, become moot or worn down. De facto, it now simply refers to the other laws. The enumeration in Article 3 is therefore purely illustrative or exemplary, not to be understood as exhaustive. Article 3 does not allow for the discrimination of population groups or persons who are missing from the enumeration. Article 3 in conjunction with Articles 1 and 2 clearly and unambiguously shows that no one may be discriminated against on the basis of their sexual preferences or their lifestyle. Of course, this also applies to all queer persons. The limit here is the same as for all freedoms: It is set by the rights of other citizens." The political left looks away One might think that the SPD would have something more meaningful to say after a terrorist attack by an Islamist than to fixate on pointless symbolic politics. But the political left in Germany is not capable of naming Islamism as a real danger to our society in general and to queer people in particular. Jan Feddersen noted in the taz: "On this eye, many contemporary leftists are blind and remain so, if they do not want to acknowledge that these dangerous individuals are right among us." Also on the news portal t-online, it is noted that "the reactions from the Social Democrats also two days later are strikingly tame." Daniel Mützel criticizes: "While the Republic was painfully shown the deadly danger of Islamist fundamentalism here at home, what was mainly to be heard from the German Social Democrats was: silence. It became even more problematic when Alfonso Pantisano (SPD), the queer commissioner of the state of Berlin, in an interview with the RBB referred to Islamists as "conservatives." A dangerous and unprecedented trivialization." Now, then, the SPD remains true to its inability to clearly name problems. In recent years, it has repeatedly become visible how fundamentalist interpretations of Islam continue to advance into the minds of Muslims. Targeted prevention work would therefore actually be necessary. One need only think of the gay teacher who was bullied at a primary school in Berlin – by Muslim students. There was apparently no support from the school administration. It was said, according to media reports, "the Carl-Bolle-Schule is attended by an above-average number of children from traditional family backgrounds, which could make the acceptance of diversity more difficult." Therefore, the teacher should adapt. This also shows: Diversity in itself is not a value, but it is a simple reality that must first be committed to values. Here in Germany, definitely to those of the free and democratic basic order. Distance from Western values Problems with students from "traditional family backgrounds," by the way, are not only experienced by openly gay people, but also by women, whose authority as teachers is often not accepted, especially by the boys. So the results of a study published in March 2026 also fit the picture, which asked how widespread Islamist attitudes are among Muslims in Germany. The Islamic theologian Mouhanad Kourchide explains in his column on Chrismon: "According to a study, around 45 percent of Muslims under the age of 40 in Germany are considered to be latently or manifestly sympathetic to Islamism. This does not mean that these people are prone to violence. But it does mean that in their attitudes they are receptive to ideologies that call democracy, pluralism, and individual freedom into question. A portion of those surveyed holds fundamentalist views, shows a clear distance from Western values, and is susceptible to radical interpretations of religion." And it is precisely here that one should intervene, alongside harsher penalties for already radicalized individuals, if one actually wants to do something sustainable and long-term for the safety and freedom of queer people in Germany – instead of tinkering with the Basic Law. Or does anyone seriously believe that Abdul Ballout would not have driven the vehicle into the crowd at the edge of the CSD closing rally if Article 3 of the Basic Law had already been expanded to include "sexual identity"? Zielgruppengenaue Präventionsarbeit wäre also tatsächlich notwendig.
