The planned transfer of trans healthcare into an ASV model will cause endocrinological care in Germany to collapse and will significantly raise the threshold for treatment.

that endocrinological care in Germany will collapse

The text deals with the impending deterioration of trans healthcare in Germany. The starting point is a 2023 ruling by the Federal Social Court, which placed the existing care provision under reservation. Federal Minister of Health Katarina Barley (referred to in the text as 'Niner Warken') is to hand the regulation over to the Joint Federal Committee (GBA). The care provision is then to be organised according to the model of ambulatory specialist medical care (ASV). It is criticised that this could cause endocrinological care to collapse, as only ASV-affiliated specialists would be permitted to treat. In addition, the threshold for an indication rises, as a core team of several specialists must unanimously agree. The text warns of a significant deterioration for all trans people, particularly also for those under 18.

Fuck, I'm 27, I'm literally an older trans woman. What the fuck? Wait, from 27 I'm an older trans woman? I still feel like I'm 25 and it's, well, 27 I've hit a bit of a wall for myself. I'm 64, but I also think trans women actually always stay young and never look as old as so many heterosexual cis women. Word. That's what the hormones do. Yes, and the hormones are what we also want to talk about a bit today, right? Access to hormones. Yes, exactly, that's what it's about, but Cornelia, you can tell us a lot about that, who are you even, Cornelia? I'm a trans woman, an older one, and I lead the facility vor B in Hamburg. That's a low-threshold addiction counseling center for gender-diverse people. And besides that, I'm also a psychologist in my second life and can therefore do a lot for people who have transition-related concerns. And on top of that, I'm also on the board of the Verband queerer Psychologinnen. That's my professional association and on the federal board of the DGTI, the German Society for Trans- and Intersexuality. So I have a lot of roles. Sounds like you don't get bored? That could, there you could say something true, yes. But basically it's like this, I get bored quickly and so I'm always happy when I have something to do. And with that, because we haven't said it yet, welcome to Kirk's The Now. Today we're talking about the health reforms that would almost abolish gender-affirming healthcare in Germany. The whole thing, the background is of course that there was a court ruling that called the entire legal basis for care into question. We don't want to go into that too much today. But a few months ago there was the proposal from Niner Warken that the whole thing would now be handed over to the GBA and within a year be resolved there according to the law for rare diseases. What does that mean? Who is Niner Warken? What is the GBA? What are rare diseases? What's coming at us? Well, the basis is that the Federal Minister of Health Niner Warken, who is known to all of us because she has, well, I don't want to say, brought the psychotherapeutic care of people in the Federal Republic to a standstill, but has clearly worsened it with the health reform she has proposed. And I think that she has something similar in mind regarding trans healthcare, so it affects me as a trans person anyway, because they have to do long-term psychotherapy. Twelve sessions, sometimes six months, sometimes twelve months long, but these rules are supposed to be tightened even further. Yes, you've already said it, the background is the 2023 ruling. The Federal Social Court, the Federal Social Court has just, well, I don't want to say, declared all trans treatments in Germany, well, I don't want to say, not permissible, but placed them under reservation and demanded that a new regulation must be created. And the Red-Green coalition had promised that they would create a legal regulation and they have dragged their feet, it didn't come to that. And the current coalition has taken over this problem and the Federal Minister of Health then chose a path because she didn't think it possible, which I also don't consider unrealistic, that she would get a trans-friendly legal regulation in this coalition and said, according to § 116 SGB V a regulation for outpatient specialist medical care, that's this ASV, a regulation is to be created and a so-called ASV annex is to be developed by the Joint Federal Committee, that's the GBA, and this annex is to be called transsexualism gender incongruence and in this regulation it is then to be summarized how the Transgender treatment in Germany will probably take place starting next year, and yes, since these regulations are actually intended for special illnesses, particularly severe illnesses, complex illnesses, that is why it actually does not apply in the context of gender diversity, because actually having a gender is not in the true sense an illness or an increase in complicated illnesses, but in Germany the new ICD-11 does not yet apply, the old ICD-10 still applies, so the International Code of Disease, where transsexualism F64-0 is still an illness, although actually all professional societies agree that this is no longer the case, but only the suffering from it has a disease value. And although this court ruling of 2023 on the basis of the ICD-11 has declared this matter to be experimental, if I understand correctly? Yes, I believe the ICD was not the subject there, but the court relied above all on the applicable S2k guideline at that time and claimed that what is formulated in the S2k guideline, above all in relation to gender diversity, is experimental, and the Federal Social Court then simply threw the case law of the Federal Constitutional Court over the top, which in 2017 determined that there are more than two genders. The S2k guideline was acting on the basis of the Basic Law and the guideline of the health insurance fund, not the MDS, which to date regulates the treatment of all gender-diverse people, and it is becoming apparent that the regulation that the ASV and the GBA will establish, that the, not only the binary gender, will not change, meaning a new regulation will be created that will not act on the basis of the case law of the Federal Constitutional Court, but beyond that it is becoming apparent, at least according to what we know so far, that those under 18, who are already very affected by the current S2k guideline, which has already expressed itself very restrictively against surgical interventions, that this will be intensified, because at the moment at least it seems that those under 18 will not be included in the new GBA regulation, so that it can be assumed that the healthcare of those under 18 will deteriorate extraordinarily, but it will now deteriorate for all trans people. But why does it specifically deteriorate for all trans people according to this model? Yes, that has various factors. So, if we assume that there will be a special regulation, because if regular ASV rules were to apply, then people can, according to the principle of subsidiarity, which has fundamental rights character here in Germany, there is free choice of physician here in Germany. And the state may not interfere in the thinking and feeling of people or may not exert any influence on it. And subsidiarity means, if you want a treatment where your psyche, where it intervenes in your psyche, influence is exerted, or on your body, then the state may not prescribe how that should happen. That is called subsidiarity. And our entire healthcare system is built on this and actually also the ASV, which means that people who do not want to be treated within the framework of such an ambulatory specialist care may also not. We assume that this will not be the case for trans, trans people, but that by the BSG having said that you can no longer, what the health insurance funds are currently doing is no longer permissible, that all trans people then have to go into the ASV, into these ASV centers. And the rules for these ASV centers, which then have to be created, are relatively high-threshold. That is to say, they must be specialist physicians who work in an ASV and who must be recognized there, and that has a very, very essential aspect on endocrinological care in Germany. Because in Germany it is the case that in endocrinology, which we all know has very poor care for trans men, it is practically impossible or only very difficult to get endocrinological care in the big cities, and in rural areas it is almost impossible. So it is only very limitedly possible, and in the future it will be the case that only endocrinological specialist physicians who work within an ASV can treat trans men, and since most endocrinologists in Germany work as contracted physicians, meaning they are not on a specialist physician position, it will be the case that we can assume that when this comes into force, the endocrinological care in Germany will collapse. That is already the first aspect we have. And we are trying to find out whether this actually applies to all trans men. So does it actually apply to new cases or also to existing cases, and that is completely open at present. That is to say, all people who need hormone treatment in the context of transgenderism, and that is a very large number, may possibly in the future have to obtain their prescriptions from an ASV setting. They can no longer do it the way it has been the case so far. That is from an ASV that has completely collapsed, or? So the ASV does not collapse, but the endocrinologists who are not ASVs, they simply drop out. Yes, but that means exactly the same thing. So if there are no endocrinologists in there who can do that, then the care effectively collapses, or? That is how it is. So the care would collapse in Germany for all those who need hormone care in their life. Does this also only affect endocrinologists or also psychotherapists, gynecologists, gynecologists? You know what I mean? No, it does not affect them. So in the future it will remain the case that the approved psychologists who have a contract with the health insurance will continue to be able to work. They can even be team leaders. They will in principle be a bit upgraded. But they also have to join the team. And yes, and we do not yet know exactly what the core team consists of, but one thing is very clear. You currently have the situation that psychologists can independently indicate. That will in any case be removed; indication can then only be done by an ASV. And that means that all members of the core team must agree to the indication. That is to say, that unlike the situation as it is now, where you have one person who has to say, I think that is okay. For example, that you get a GAUP. Then in the future, we estimate that it will be at least four people. So endocrinology must agree and possibly gynecology and urology will be added. And that, we must all be specialist physicians. That is to say, you have a very high hurdle situation of people who all then must agree with the treatment. They must do it unanimously, and with that the hurdle to get an indication increases manifold. Because they all have to be trans-affirming, they all have to agree in the individual case, and without the participation of all parties no treatment will take place anymore, no indication will take place anymore. So that the hurdle to getting an indication actually increases manifold. How many such ASVs are there at all? And how many would be usable for trans people, so to speak? There is no ASV in Germany at all that would be usable for trans people, because they have not yet been founded. There is a whole series of ASVs for a whole series of difficult medical conditions, I can't give you the numbers. For trans people, there would be no ASVs, they would first have to be established. That means there is a complicated application process. It is also a complicated billing process, because in Germany the designated doctors cannot bill, as is usual within their regular practice organizations, but only with the Bavarian Association of Statutory Health Insurance Physicians. And the software that we, as psychotherapists in the public system, use is not at all designed for ASV billing. That means the establishment of an ASV is not only associated with a considerable amount of logistics, but the billing is also extraordinarily difficult to organize. So this is associated with very, very high formal effort, so that we assume that only well-equipped clinics are able to establish ASVs. So in Hamburg it would be realistic that the UKE could establish an ASV. That means that the current care that we have at the UKE, that it could probably continue under the current conditions. But then there would be no further care in Hamburg. And anyone who knows what the care situation in Hamburg is like, if it could only run through the UKE, can imagine that we will get conditions like in the USA. No, do you get the USA, it's not that far yet. No, conditions like in England. That means that we will probably get five or six ASVs, which will then be attached to the university hospitals and the university hospitals, you also know, are under considerable pressure, also under considerable public pressure. That means that the treatment of trans people in this context runs much more regulated, perhaps under much stricter criteria. In Hamburg there has just been harsh criticism from the community regarding the work being done in the under-18 area. That will certainly not be easy for these centers. We have to be clear that there will perhaps only be 300 treatment places nationwide. And they will be fully booked for years to come. So we will in principle, as the, you can assume, if this is implemented, that the treatment of transgender people in Germany will effectively come to a standstill. Unless there are no more than 300 trans people per year. Yes, it will be a super-elite system today, which of course will also totally amplify this idea of this True-Scum-Shit. That is, that people who then made it in there will perhaps see themselves as the only real trans persons and that this will then also be reproduced by these doctors who then say, yes exactly, all the others are just fakes. You can see in many places that around these hierarchical, elite systems, why such ideologies also arise. And I believe that something like that actually drives transitions too, that through this more transitions take place, because the pressure on these people is so to speak higher, that they have to perform all the time, that they have to prove all the time that they are real and that they also have to prove that they suffer all the time and have to perform their own suffering. That is also such a thing. So this will definitely also lead to a more binary gender image being instilled, because I mean, it is already the case that it is super difficult to get any non-binary transition in Germany at all. And I cannot imagine that this is beneficial, yes the opposite. But the thesis has always been that non-binariness is taken into account. What do you think about that? Or also about the other things we have said? No, I have said too much. So first of all I am not a finance of the transitions. So I can always only say, the transition, Hooray! That is a completely crazy idea. That that would be a bad idea if people were to detransition. So I think it's a good thing. So everyone who doesn't need hormones and doesn't need surgeries, wonderful, and those who somehow notice it in the course of things, excellent. So it can't really go any better than that, this whole transition thing is exhausting and difficult. And if you don't need it, at some point in the course of things, you notice that, that's great. So that's not the point, but on the other hand you're right. When people walk around and there's a whole crowd of people who are therapeutically on the go in the trans context, who have this idea of properly trans and falsely trans, with that you can cause a lot of nonsense. So if you believe that there are false transgender people and true transgender people and then you have a wild thesis in your head and then you have to be able to somehow figure out who is then true and who is false. And you're right, if you walk around with this thesis that you need and that will certainly be the case in the US. You have to somehow figure out who is true and who is false. Then you force people into performing. That is, people then want to perform properly so that they don't get sorted out, because they have some kind of transition concern and that is a self-sustaining system that then arises. So they all fertilize each other mutually. That is, what we all who are in the community know, is that there are, so to speak, the trans people who are in therapy and the real trans people. So that's not the same thing. So the people who are in therapy are playing some kind of role and who knows what, so the popular classics. I always only played with Barbie, as a trans woman. So and the system, the trapouts who hear that all day long think that's how it is. And expect it to be like that in the end. And of course, they are a bit smarter today or they at least act smarter, but in the end it's like that, that completely crazy things come out of it when you're on the funnel of false and true. And there are from the trans community without end, no, I don't want to say without end, but there are a few know-it-alls who also walk around with these things and give interviews at EMAS and explain that they are the truest trans people in the world, truer than others. And of course it also fundamentally goes into binarity. I think binarity is really a difficult topic that we need to talk about separately again, because I don't think it's so easy to resolve. It is very rare that people don't identify at all in relation to man and woman, so completely outside the system. And you always have a few binarities that you can't get around, so testosterone and estrogen, those are binarities that you have to somehow deal with. That is, there are so in the system, there are so fixed binarities. And if you now can't really identify with it, certain steps don't make a whole lot of sense. That is, I believe the idea of binarity is simply the ground. If you look at it scientifically and then ask people how they locate themselves, then you have 16 percent of people who locate themselves binarily, so also purely as man or purely as woman. All others don't do that. All others know that it's a bit more complicated. That is, this idea of binarity that the Turfs in the classical sense represent, that is a fiction. It doesn't really exist. And what we can safely assume is, however, that this fiction in the context of the US will certainly be represented. And that the health insurance companies do it too and that will certainly not be resolved. I don't believe that the ASV will operate on the ground of the Basic Law or the case law of the Federal Constitutional Court. There are perhaps reasonable reasons for this in part, because, as I said, traditions sometimes have a tendency toward binarity. That is also always a bit the question: where do you set the boundary of what you consider feasible? That is a kind of parsing discussion question. So, do you want all people to fit into heteronormativity or cisnormativity? And where is the boundary there? That cannot be so easily resolved from my position. In that sense, I find such a helper construction sometimes helpful, but you are right. That leads to the consequences of right and wrong. I am quite certain that if you are on this trip that there are right and wrong transgender people, then you produce, then you have priced in the error. Then we know for certain, it must be wrong, because the case will happen where it is indeed wrong. And if you do not think that through from the outset, then you have the problem on your hook. And you are right about that. Then this phenomenon of D-tradition arises as a kind of othering of transsexuality. That is partly very much served by the trans-friendly organizations, when one does something like what Gentspect does, who hold such D-transition congresses and then people pick up on that. There is also a well-known person in Germany who cultivates that very much. And that is a consequence of right and wrong. And that will certainly be exacerbated by it. Yes. Can we still do anything about that now? So what is it actually that one can do, to now somehow, can one still prevent anything? Can one still change something, influence something? Or is that just going to happen? Or can one perhaps also do something to prepare? I would have an additional question on that. You just said that that will probably be against, so against a Federal Constitutional Court or so against a ruling, that a third gender option, if I understood that correctly, is the 20

What the fuck? Also habe eine Menge Funktionen. Klingt danach also, ob dir nicht langweilig wird? Das könnte, da könntest du was Richtiges sagen, ja. Was bedeutet das? Wer ist Niner Warken? Was ist der GBA? Was sind seltene Krankheiten? Du weißt, was ich meine? Was denkst du dazu? Also da befruchten sich dann alle gegenseitig.
