The biblical commandment to establish independent and incorruptible courts is a timeless prerequisite for just coexistence and the preservation of the community, one that remains valid in modern states as well.
You shall not pervert justice. You shall not show partiality. You shall not accept a bribe. For a bribe blinds the eyes of the wise and perverts the words of the righteous.
The text analyzes the biblical weekly portion Shoftim (Deuteronomy 16:18–21:9) with a focus on the commandment to appoint judges and officers. The speaker distinguishes between the preventive role of the police (protection) and the reactive role of the judges (decision after the fact). He connects the biblical demand for just adjudication with modern problems such as bribery, political influence, and unequal treatment before the courts. Using the example of the UAE and historical kibbutz experiences, the necessity of a functioning, independent legal system for all citizens, including strangers, is emphasized. The central message is that justice and the avoidance of arbitrariness form the foundation for survival and possession of the land. The text calls for self-criticism, since even believers often demand justice for others but mercy for themselves.

They tell us in the avodah, in the avdata, they do the same thing with the same thing as the promoters. Friday 6 PM and I am glad that despite the rather very hot temperatures, 34 degrees in Erfurt, 34 degrees in Berlin, we still have some female and male viewers, and it is also still a bit of holiday season. And I am glad that Rabbiner Walter-Rutschelt has made himself available, because it is also a risky job. It is told multiple times in the Torah, if one engages intensively with the Torah, one can rekindle the fire from Sinai. And it is already hot enough. And we have today a very, I also think, I fear perhaps always current Parashah, weekly portion. You find it in the fifth book of Moses, Deuteronomy, chapter 16, verse 18, and that goes until chapter 21, verse 9. And at the beginning it is about the judges, about judging, and therefore the weekly portion is also called Shoftim in Hebrew. Judges and officials should be appointed, Luther translated the beginning as "in all your settlements". And this is of course a very important principle, also in our present. Our rule of law consists of the separation of powers or is composed through the separation of powers. The legislation, the legislature, the executive power, the executive, and the judiciary, the judiciary. Some say today we still have a fourth power, that is the media, but that is not our topic today. In any case, the judges and the judiciary are a very essential part also of our modern state. And apparently also already in ancient Israel, dear Walter. Yes, it is actually 7:30 PM, Brathe in Berlin. A good preparation, before we will all go, perhaps. We are already practicing, yes. The book Deuteronomy is anyway a collection of memories and last-minute thoughts and so on from Moses. These are his drafts, and he tries to pack in everything he can. And there are in each Parashah here several topics. From the feeling that all last, the penultimate, the last, a last song. And the problem is, why should one speak today? We only have half an hour. And it begins with, yes, they should or you shall appoint judges and Shoterim, police officers, watchmen. And then it is about the role of the priests and it is about the distribution of power. And at the end it is also about war and what one may do in war and what not. There are several topics and one cannot do everything. So, my intention today is simply to begin at the beginning. That sounds logical, but does not always happen. And ask a few questions. And then see how far we get in the time we have. So, chapter 16, we are already halfway through, verse 18, here our Parashah begins. This is for many people perhaps already an interesting question, why do we begin here? Directly after the whole series of holidays and so on. Here it comes quite clearly, Shoftim Vashoterim Titzen Lachas, a single, you shall do it to the people. A Shofet is someone who decides with a gavel. So the court proceedings, the decisions, the legal decisions. One also has the word Dayan, for judges, when it is about religious matters nowadays. A Dayan decides and makes a Din. A Beit Din is a house of the court, house of the judges, a religious court. But a Shofet decides, one could say, one has civil questions. A Shoter, what is the question? What is your Shoter, a policeman? What do the police actually do? What should they do? Of course in our television there are crime shows everywhere. And every crime show means at the beginning a murder and then 40 minutes later the arrest, everything clarified and so on. Actually the task of the police is to ensure that nothing happens. That is of course not interesting for the television producers. That brings no advertising revenue in. But when a policeman stands on a corner, when someone stands in front of the door, a building, when someone stands at a school and so, that
That is what it stands for, so that nothing happens. If something has happened, then of course one must investigate like a detective: who did it, what forensic traces are there, what clues are there. Whom can one arrest, and so on? How can one then prove that the man you have arrested is truly the perpetrator? There are several problems, but at the beginning, a judge is not a detective, but a prosecutor. A prosecutor stands there so that no one does anything foolish or evil. If a judge decides, if something has already happened. We already have interesting questions before us, even in modern society. What exactly are the roles of such institutions? Does one need a whole series of district courts, regional courts, federal courts, just so that everyone knows they exist there? Or should they always be working nonstop? If one knows that one can be brought to court, then one should hopefully behave differently and then not do anything foolish and then not end up in court. Is that a job-creation measure? Or is it a preventive measure to avoid things going badly? You shall do this. Put judges in all your gates; the city gates were the red ones, where the court assistance was located. Appoint all the elders of the tribes daily. God will give them these city gates. They themselves will have to build this city completely. They will take over the land, it must be said. But there one needs a court, you see. And what should they do? "I have appointed judges and officers for you, and they shall judge the people with a just decision." That means, there is also something else. Otherwise, it will not be necessary, you may say. I recently read an interesting book about the history of Kibbutz Degania. One of the first kibbutzim founded in Palestine. And the capabilities that the young settlers there had with the Arab tribes in the villages around. And there is an interesting dialogue, some years later, where one of these Arab bandits says, the good old times, back then we did this and that, we could, can you ask here, whether we shot so and so, we wanted to steal all the horses. I shot one of your people because I wanted to take his horses, he did not want to give them up, so I shot him, just like that. And I found nothing wrong with it. It was almost amoral. But now we say, now the English are here, in the Mandate period. And they have reformed the entire court system, now it is no longer a joke. And one thinks, my goodness, what a concept, what a perspective. These people think it is really a joke. If one has a rifle, one may shoot anyone one wants. If one sees someone with a horse, one may steal it. And if he resists, get rid of him, finish him off. And that was how it was. And that is still how it is in many parts of the world. So this legal code that we have here is so progressive, even if, from time to time, like some parts, one finds that are still a bit outdated. I mean, a few verses further on, it goes to the stoning of offenders. That is not done so often nowadays. But the idea, one should have a court where people can go and say, something has happened. I feel treated unjustly. Someone has taken something from me, someone has said something about me. Someone has threatened me. And one goes to an authority. And one says, please help me. I have rights, I am a citizen here. I am a member of this people, a member of this community. That is important. By the way, in other parts, the Torah also states the same concept, that there should also be only one court system, especially even for foreigners who are not citizens and who live under the same legal system. I read a very interesting article yesterday about the United Arab Emirates, UAE, where right now
A thread-like agreement has been created with this work. It is a totally split state. There are the Emiratis, who have to do nothing. They all have so much money. Then there is the middle class. And then there is the working class. They are all immigrants and they have no rights. We have also learned this in other places, where, for example, large football stadiums must be built. Now, for the upcoming World Cup, the people are treated like slaves, the migrants, the migrant workers from Asia. So if someone says there should only be one legal system, that it is so exact, so simple, it is not so. It would not be necessary to prohibit this if it did not happen. You shall not bend the law. You shall not show partiality. You shall not accept a bribe. For a bribe makes the wise blind and perverts the words of the righteous. I still subscribe to a few English magazines, which are full of political complaints about large industrial projects that violate all laws, but somehow one always gets permission if one has donated enough to a certain party. Or a certain institution or a certain company. If one donates something, then it is no problem. Bribery exists here and now, also in the Western world, also in Europe, perhaps not quite as bad as in some American states or so on, where it is part of life, but it still exists. And it makes blind. One sees the money, not the people or their problems. Zedek, Zedek, Thirdow, after justice, after justice you shall strive with emphasis. An echo here from Leviticus, so the Third Book of Moses, Chapter 19, Verse 15. And there is also something very, very similar. Mrs. Dürrvüsten, you shall not do injustice in the legal proceedings, do not take into account the poor, do not favor the great. You shall judge your neighbor with justice. So there is also, of course, the possibility that one goes a bit too far in the other direction, shows too much compassion, too much tenderness towards the poor. That is also unjust. We are now just one month before Yom Hadin, Rosh Hashanah. Yesterday was the new moon of Elo. We have these four weeks of preparation, today I heard that they blew the shofar in my house. Yom Hadin judged justice. We always want to change justice and tenderness for ourselves. Is that not true? For us personally, oh, please, oh God, make a recording. I did not mean it, I am just a weak person, the others should receive their proper punishment. Unfortunately, most people see all these cases this way. We are all human, we all want to have a few more tests for ourselves. But according to the law, we are all equal. The Prime Minister, the President of the State, the Chief Rabin and the little guy right in the back. We have the same duties, to fulfill with the word, the same punishments, if we do not do so. Zedek, Zedek, Tirdov. And why? So that you may live and possess the land that the Lord your God gives you. Here is also an interesting political question. To what extent are the two linked? Possession of the land and our behavior? God gives the land? Altenaynata, an der Naila Kar, God can give, God can take, if we deserve it. So to what extent should we then influence the whole thing through our behavior? And what will it mean? And what will it do? Would we not get the land? Would we lose the land? Would others come, Babylon and so on, take, just because we no longer deserve it. This is the highest matter in many respects on a communal level, not dignity, but communal. You shall not stand by the altar of the eternal
of your God, which you set up for yourself, you shall not plant any tree, absolutely no tree. You shall not erect any stele, for the eternal, your God hates. So it is completely clear here that when we speak of a cult, a new altar, a new cultic center, not yet called a temple, but a sanctuary, there must be no compromise there. It must really be exactly so. And it continues, if we have 17, if we have this altar, then only the perfect may come upon it, yes, only that all healthy animals and so on come. But what happens if the covenant law is violated? If in your midst, in one of your gates, which the eternal, your God has established, a person is found, be it a man or a woman, here is the guilt, man or woman. He does what is evil in the eyes of the eternal, your God, by transgressing his covenant law and going to serve foreign gods, bowing down to the sun, the moon, and the whole host of heaven and the stars, as I have forbidden. And it is reported to you, and you hear it, and you have investigated it carefully, and behold, it is true, this testimony is verified, this deed has truly happened. Then you shall take that man or that woman who has done such an evil thing out to your gates, and whether he is a man or a woman, they shall be stoned until they die. Above all in the execution, the death penalty, but it is found everywhere, even still, purely theoretically in Great Britain it is not yet forbidden. One may still carry it out for treason, yes, state treason. And the entire James Bond series is based on the idea that one may have a special license, in the name of the Queen, to kill others. But here it is interesting to note, what happens if the law is broken. But that is the next question, and it comes with every, the parental part with every little child, one says, do not do that, and the child does it anyway. Takes the very last cookie, breaks a toy, says something very evil. How can one punish a child? To what extent is your child responsible for his actions, his speech? To what extent is your growing one responsible for what he or she says? One says, do not do that, we have for the commandments no adultery, no murder, no slander, to keep the Sabbath. And then someone comes and does it wrong anyway. Consciously. Is it conscious, one must ask. I find this passage also very interesting, because we have here several words, which are also a bit moving, to take in, like Stögel, Hemmels, Schemerschwerweger, which little belts it was reported to you. Shemata, you hear this report, you are reported, a neighbor, a spy, an agent. But the Raster, the Tive hinnä – na, na! Na, na! One must check whether it is really the truth. S'tata t'ay vaha'zot, that someone has truly done such an evil thing. It is not published, it is not made public, but it can happen. But hud t'ata et ha'ishu oet ha'ishachai ji. Asha'su et hata vaha'raha ze el the Lord Scharlrich has. But before that, one must really check. You have investigated carefully. Here is the detective work. Here is the investigative work. So it is not enough if someone comes and says, so and so has done something evil, do something. One must be able to prove it. And if not, then not. And it makes it quite clear how to do so. For example, they execute on the testimony of two or three witnesses. He may not be killed on the testimony of one witness. On the other hand, one could say, okay, killing, execution, official punishment, anyway something evil and worst. On the other hand. One can see here at least a restriction. One witness alone is not enough. A rumor, a betrayal, an anonymous call to the Stasi or the Gestapo or whoever is not enough. It may be, there is really something evil. And then one must do something
Misbehavior. But then one must take this seriously, because the potential victim has the right to expect that those who examine the case examine it neutrally. Examine it truly neutrally. Take no interest in which party he is, how wealthy he is or she is, how poor, whether citizen or foreigner residing there; they too are to be excluded. The hand of the accuser shall first be raised against him to kill him. And then the hand of the whole people. Thus, the one who brings this accusation must participate. This is severe. He cannot say, I have given an anonymous report to the police, now my hands are clean and I need not do anything. No, he must truly do it. He is speaking, of course, of a relatively small society. Everyone knows everyone; at that point they are still in a large encampment in the wilderness. Later they will be in cities that are large for them, but for us will look like a village. One is not entirely anonymous. Everyone knows everyone, everyone sees everyone’s house, everyone knows where their children are, to whom they belong, and so forth. If something truly evil happens, one must do something. We have a problem in modern society, I will say, that very frequently, not always, but very frequently there are cases where something evil has been done, but the judges want to do nothing. The state, which oversees the court system, says we do not want to interfere. This is so difficult. This is an internal party matter or a religious, internal matter. We do not want to interfere in an institution. And then it may come to light perhaps 20 years later that in this boarding school or in this church there was sexual abuse or abuse of office or bullying for years. No one did anything. No one wanted to take action. They were cowards. Here stands the society. These judges have the duty, if necessary, to remove people from the society. Today we would say, into a prison. At that time there was no prison. They were on the move in the wilderness. One cannot simply say, oh, stay in your tent. One could throw people out into the wilderness to die slowly. That is also no great blessing. In some way, the layers of Hagar and Ishmael. Stoning is a very interesting method of executing people. I have not done it personally. I am going to be quite abstract for you here now. But it is the same principle as a, what is the group called, a command of people who are to shoot someone. Yes, a firing squad. If there are five soldiers and one person, and perhaps of the foot soldiers only one has live ammunition, another does not, but no one knows which, then no one knows who actually executed the victim. And perhaps all five have live ammunition, but no one knows afterwards which one hit first, which one did something first. This is different from when a single person takes a rope, makes a knot, and the gallows, or if someone does not use an axe to behead someone, then it is entirely clear, this person takes on the duty, the society. But if the church is already so to speak anonymous, then the responsibility is distributed, divided among all. If ten or twenty people take a stone and throw it, of course it is cruel, but no one knows which stone actually delivered the death blow. No one knows who should take on the responsibility for the life. It is a joint communal act and no one can step aside and say I do not want to. This is an interesting concept when it comes to communal responsibility, communal duties, but it can really be grim, therefore there is verse 8, if the decision over a case is too difficult for you. It concerns bloodshed or legal disputes or bodily injuries or other matters of dispute in your gates. Then you shall set out and go to the place that the Lord your God will choose, you go to the priests of the Levite tribe, and they take
Judges, for that day shall come, and ask them. Thus, there is a higher court. Before Din, Le Din, and before Nener, Nege, Divreri, Judges, and Schaarechen. The renowned Alita, Elhamah Komashayev, Ha'ad-Naila Hechevo, Huwate Elha Kohanim, Wahalvi'im, Elha Shofet, Ashe Ihiyeh, Be'yamim Ha'him, B'he Rasta, Behegidulacha, Et Devahamishpat. This matter is truly very, very important in that psychology, because it is written here: you go to the judges of the times, of now, of then, or of all time. It is not something that remains fixed and firm forever. Your judge of the days, he shall decide. And that means, he is not bound by the decisions of before and their proceedings. He can end the law, because he speaks for his times. A very important concept. He speaks for his times. There is modern technology, modern methods, modern concepts of psychology. When is someone truly in a position to be responsible for his deeds, or where one is not actually capable of being responsible for what he has done? Who decides? The judge of now, not the judge of then. That is how the Rabbis have always understood it. The judge of Benjamin Haheim, of those days. I also find it a relatively important concept. It allows for changes. It allows for a certain flexibility. There is continuity. The

Te kasha bata in avdis in avdata, te karo stufu asso so gado le promoto. Was machen die Polizei eigentlich? Was sollen sie tun? We schaffterre, we schaff tu et ham, be mischpatze dek.
